1. The Service
Chart Poppers provides free tools for creating animated charts, graphics, PNG images, and MP4 videos. Some features use artificial intelligence and third-party technology to interpret prompts, generate artwork, and create animations. Features may change, become unavailable, or be discontinued at any time.
2. Acceptable Use
You may use Chart Poppers only for lawful purposes and in compliance with these Terms. You may not use Chart Poppers to:
- Create, request, upload, or distribute sexually explicit content, nudity, sexualized depictions of minors, or sexual exploitation.
- Create or distribute slurs, hateful content, racial stereotypes, demeaning caricatures, or harassment targeting a person or protected group.
- Promote violence, terrorism, exploitation, discrimination, abuse, or illegal activity.
- Defame, threaten, impersonate, or unlawfully target another person.
- Upload content that violates another person’s privacy, publicity rights, intellectual-property rights, or other legal rights.
- Attempt to bypass, defeat, manipulate, or probe Chart Poppers’ safety filters or technical controls.
- Overload, scrape, reverse engineer, disrupt, or abuse the service.
- Use the service to create spam, malware, deceptive materials, or fraudulent content.
Chart Poppers may refuse a request, stop generation, withhold a preview or download, remove content, limit access, or suspend or terminate use when it reasonably believes these Terms or applicable law may have been violated. Automated safety systems may occasionally make mistakes. If you believe a request was blocked incorrectly, contact us at chartpoppers.admin@gmail.com.
3. User Content and Data
You are responsible for the prompts, data, CSV files, images, labels, and other material you submit. You represent that you have the rights and permissions necessary to submit that material and authorize Chart Poppers to process it for the purpose of providing the service. Do not submit passwords, financial information, medical information, confidential business information, personal identifiers, or other sensitive information unless you are authorized to do so and understand how it will be processed. Prompts, chart data, and creation requests may be processed by third-party technology providers that help operate Chart Poppers. See our Privacy Policy for information about collection, processing, retention, and deletion.
4. AI-Generated Content
AI-generated charts, artwork, text, and animations may be inaccurate, incomplete, unsuitable, or similar to material created for other users. Chart Poppers does not guarantee that generated content is unique, error-free, or free of third-party rights. You are responsible for reviewing content before using, publishing, presenting, or distributing it. You may use downloaded charts and animations for lawful personal, educational, business, presentation, and marketing purposes, subject to your responsibility to confirm that the resulting content complies with applicable law and does not infringe third-party rights.
5. Ownership
You retain rights in content you submit, subject to the permissions necessary for Chart Poppers and its service providers to process that content. Chart Poppers and its licensors retain all rights in the website, software, branding, themes, preset scenes, design, code, and service materials. These Terms do not transfer ownership of those materials to you.
6. Downloads
PNG and MP4 downloads are provided for your use as generated by the service. You may not remove copyright notices, falsely claim that Chart Poppers’ software or themes are your own, or use downloaded material in a way that violates law or another party’s rights.
7. No Professional Advice
Chart Poppers is a creative and visualization tool. It does not provide legal, medical, financial, educational, safety, or other professional advice. You are responsible for independently verifying information used in important decisions.
8. Disclaimer
To the fullest extent permitted by law, Chart Poppers is provided “as is” and “as available,” without warranties of any kind. We do not guarantee uninterrupted availability, preservation of drafts, accuracy of AI-generated content, compatibility with every device or presentation program, or that the service will be free from errors or harmful code.
9. Limitation of Liability
To the fullest extent permitted by law, Chart Poppers and its owners, operators, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from your use of or inability to use the service. Our total liability for claims relating to the service will not exceed the greater of the amount you paid us during the preceding twelve months or $100. Some jurisdictions do not allow certain limitations, so some provisions may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Chart Poppers and its owners, operators, employees, and service providers from claims, losses, liabilities, and expenses arising from your submissions, your use of the service, your violation of these Terms, or your violation of another person’s rights.
11. Changes and Termination
We may update these Terms by posting a revised version with a new effective date. Your continued use of Chart Poppers after changes become effective means you accept the revised Terms. We may suspend or terminate access to the service at any time, including for suspected abuse, safety violations, unlawful conduct, or technical reasons.
12. Governing Law
These Terms are governed by the laws of Colorado, United States, without regard to conflict-of-law principles. Any permitted legal action must be brought in the courts located in Jefferson County, Colorado, unless applicable law requires otherwise.
